Ohio where the court extended the exclusionary statute of the Fourth Amendment in the states. In Terry v. Ohio, the court upheld the right of police to conduct forcible searches and detentions without necessarily meeting the principle of probable cause required under the Fourth Amendment. The Fourth Amendment protects United States citizens from unreasonable and unwarranted searches and seizures. The trial court in Terry V. Ohio denied the theory of the prosecution that the officer searched the suspects prior to a lawful arrest. This is because the Fourth Amendment applies to people in the street as well those in their homes. Therefore, the three suspects were protected against unreasonable seizures and searches as anyone else in the United States. The Fourth Amendment protects people, not places, therefore, the Detective, McFadden, could not subject the subjects the suspects to unreasonable searches without probable cause.The trial court also denied the defense lawyerà ¢Ã ¢â€š ¬s argument to suppress the case because the three men rights were infringed by the unreasonable search of the Detective McFadden. The issue in the case was to determine if the evidence was admissible and not the police officerà ¢Ã¢â€š ¬s conduct in retrieving the evidence. The trial court chose to ignore the conduct of the police officer in searching the suspectà ¢Ã¢â€š ¬s outer garment because of the strong probable cause. The suspects circled the same store for a while meeting in street corners in a suspicious manner. The trial court chose to accept the weapons because of the probable cause, which the officer had of searching the suspects. The courtà ¢Ã¢â€š ¬s decision to uphold the right of the law enforcement officers to search and seize evidence with less than probable cause established under the Fourth Amendment was contrary to the decision in Mapp v. Ohio (LII, 1992).The trial court chose not to apply the exclusionary rule in the case because it could undermine the e fforts of the police to carry out investigations. Restrained and investigative police techniques were to be undermined if the exclusionary rule was applied. The Fourth Amendment excludes citizens from unreasonable and arbitrary searches. However, the exclusion could not apply to situations where the police were carrying out legitimate investigations. However, the court sought to maintain the exclusionary rule of the Fourth Amendment as a remedy to protect the citizens from police abuse of power. Therefore, the courtà ¢Ã¢â€š ¬s decision to approve the police techniques of stops and searches without probable cause that meets the exclusionary rule of the Fourth Amendment was not to discourage the remedies. The trial court agreed that the exclusionary rule was not a sufficient measure to ensure protection of citizens from police abuses. However, the exclusionary rule could not apply in cases where the law enforcement officers were doing legitimate investigations for the public good.The decision of the court set the precedent that the Fourth Amendment still applies in the cases of "stop and frisk." The Fourth Amendment protects the citizens from unreasonable and arbitrary seizures and searches. The court established that police officers had to have probable cause for the exclusionary rule not to apply. The police officers could not apply "stops and frisks" arbitrary without reasonable cause. The court defined seizure as when a police officer restrains a person and denies them the right to leave (Katz, 2005).The law enforcement officers under the precedent set by the court decision have a right to do a body search of the persons they restrain. The officer can do an outer frame search of the persons they restrain if they reasonable believe they may be concealing weapons. The Fourth Amendment defines a search as a careful search of the outer surface of a suspect. During situations where a police officer believes, his safety is in danger they may carry out a reasonabl e search regardless of whether they have probable cause to arrest the individual. However, the court limited the powers to situations where the swift actions were necessary. The court upheld the need for police officers to obtain warrants in circumstances where it was sensible to do so before a seizure or search.The officers must exercise reasonable probable cause in light of conditions to a case. The rationality of the actions of the police officer is on the scale of whether a rational person deems the actions appropriate or warranted in the circumstances. If officers are doing legitimate police investigations on suspicious characters, they can do order stops and frisks. The officer can neutralize immediate threats to bodily harm by responding appropriately to establish whether the suspect is concealing a weapon. Meet Eleasa, 1st Year Medical School Student Newlywed

This  interview is the latest in an Accepted.com blog series featuring  interviews with medical school applicants and students, offering readers a behind-the-scenes look at  top medical schools and the med school application process. And now, introducing Eleasa†¦ Accepted: First, can you tell us a little about yourself? Where are you from? Where and what did you study as an undergrad? Whats your favorite non-school book? Eleasa: I was born and raised in South Carolina and decided to attend the University of South Carolina (go gamecocks!) for undergrad because they had the #1 international business program in the country. That’s right, I started off as an international business major and had no intentions of going into the medical field. Then, one day I realized that a career in business did not sound very fulfilling to me and that I wanted to work in a job where I could directly see how I was benefitting people. This led me to change my major to public health my sophomore year and shadow people from just about every health profession (nurses, OTs, PTs, researchers, PAs, NPs, physicians, etc.). After I shadowed a family physician, I knew I had found a career that would provide the intellectual stimulation and interpersonal interaction that I was looking for. I read a ton of physician autobiographies after I decided to go into medicine (just to make sure I knew what I was getting into) and still enjoy reading about those that have conquered medical school and residency before me. One of my favorites is Blue Collar, Blue Scrubs by Michael J. Collins. Dr. Collins chronicles his journey, going from a construction worker in Chicago all the way to an orthopedic surgery resident at the Mayo Clinic. This is definitely inspiring and shows you that med school and a career as a physician are achievable with persistence and hard work. Accepted: Where do you go to med school and what year are you? Eleasa: I attend the University of South Carolina School of Medicine – Greenville and am currently a first year student. Accepted: What is your favorite thing about med school so far? And if you could change one thing, what would it be? Eleasa: I have really enjoyed my hands-on patient care experience so far. At my school we become certified Emergency Medical Technicians and ride on an ambulance with Greenville County EMS once a month. In addition to this I have gotten to take histories from real patients in the Emergency Department for my Clinical Diagnosis and Reasoning class. Being around patients really motivates me and reminds me what I’m working towards. My school opened just three years ago, so with such a new school that means that there are occasionally hiccups or kinks to work out regarding our schedules and how they do things. However, they really listen to student feedback, and I feel that we have a great amount of input regarding our education. Accepted: Congrats on your recent marriage! Looks like you have a lot to get used to all at once how are you managing during this adjustment period?   Eleasa: A lot of people thought I was crazy for getting married 9 days before starting medical school. It definitely was a rollercoaster having my wedding, going on a honeymoon, and getting back and immediately jumping into schoolwork. However, I wouldn’t change a single thing about it. I didn’t want to plan a wedding during medical school, and I am so glad I got married during the summer when I didn’t have anything else on my plate to worry about. It has been wonderful having my husband by my side throughout this transition. He is constantly encouraging me and supports all my hard work. I also think that being married has motivated me to study more efficiently. I know the less time I have to spend studying at home, the more time I get to spend with him! Accepted: Did you go straight from college to med school? Or did you take time off? If you took time off, how did you spend your time? Eleasa: I took a year off before staring medical school and worked as a dialysis technician during that time. This was by far the most difficult job I have ever had, but I’m so glad that I did it. It taught me to respect those in every position on the healthcare team and gave me great hands-on patient care experience. I know that this clinical experience really set me apart from other applicants because I got asked about it at every single one of my interviews. Accepted: Looking back, what was the most challenging aspect of the med school admissions process? How did you approach that challenge and overcome it? Eleasa: The MCAT was definitely my nemesis when I was applying for medical school. I barely studied before I took it for the first time, and no surprise, this resulted in a really low score. I realized that I needed to make a detailed study schedule and change up my study methods. This resulted in 10 weeks of intensive studying (4-6 hours a day, even while I was on vacation), making lots of notecards, and doing practice problems and sample tests. Those 10 weeks weren’t always the most fun, but it was so worth it when I got my score back. Accepted: Do you have any other advice for our med school applicant readers? Eleasa: I say to get lots of clinical experience before you apply (this will give you lots of great stories to tell and examples to give on your interview day), and keep a running list of all of your volunteer/research/extracurricular activities as you are going throughout school. This will make it so much easier to pull your application together and get it in early. Accepted: Why did you decide to blog about your experience? What have you gained from the experience? What do you hope others will learn? Eleasa: I decided to blog as a way to keep a â€Å"diary† about my medical school experience. You hear so much about the constant studying and burn out, but I want use this blog as a way to reflect on the positive things that are going on both inside and outside of school. The law of supply and demand describes how prices will vary based on the balance between the supply of a product and the demand for that product (Wikipedia, 2005). If there is a balance between the supply, (the availability of the product), and the demand, (how much product the consumers want), then the price for the product would be considered good. If there is an imbalance, the price will change. According to Adam Smith, the invisible hand is a self-adjusting force in the market that corrects the price of a product through supply and demand (Colander, 2006). When a product is in short supply and there is significant demand for the product, the price will increase (Colander, 2006). When the quantity of the product is greater than the demand, the price will decrease (Colander, 2006). This assumes there exist a competitive marketplace. This process of price variability based on the supply of a good and the demand for it will continue until a balance is once again reached (Wikipedia, 2005). At that point, equilibrium is said to be established between the supply and the demand. Kirzner (2000) commented: The theory of supply and demand is recognized almost universally as the first step toward understanding how market prices are determined. With college costing a fortune these days at an average of $9,139 for tuition, not including room and board, this puts a dilemma on the average American family making $55,000 per year. How is it feasible for a family to spend 2/5 of its income on the education of their child while still trying to afford their bills? It’s not. Under the College for All Act, the federal government would cover 67% of this cost, while the states would be responsible for the remaining 33% of the cost according to Sanders plan. No. This plan is achieved by implementing a Robin Hood Tax on Wall Street within hedge funds and investment houses, 0.5% tax on stock trades, 0.1% tax on bonds, and a 0.005% fee on derivatives (Sanders). A cult is a group of people that are bound together by an appreciation of the same thing, person, ideal, etc. Usually these groups keep close because of religious reasons, but their beliefs are almost always considered strange by outsiders. Cults are similar to clans or congregations, but are usually referred to as sects. There are many different categories that a cult could be sorted into. Apocalyptic, Utopian, Spiritualistic, Satanic, and Witchcraft/Voodoo cults are just some of the more basic types. While an Apocalyptic cult would focus on the end of the world, a Utopian cult would center more on a perfect land, or in other words a heaven on Earth. This city is very well connected with other parts of India by a very extensive set of railway lines and roadways. There are two distributaries of the river Ganges, Varuna and Assi (the name Varanasi came out of the conjunction of these two small rivulets) which flows beside Varanasi. The rich and very immaculate industries of silk work, music, education and cultural heritage were to be protected. Since the issue of potable water is a very big issue during any flood situation the collection of potable water in tanks and storing them suitably is a very vital issue. To conserve resources each individual will be provided just two meals and two litres of potable water every day. Since storing of these two essential commo dities will not be possible all that fast it will be necessary to move food and potable water by small manually operated boats which will be obtained from the army. However, the doctors will be put on alert and will be told to attend duty at any place they are asked to by the disaster management team. Doctors from the armed forces will also be requested for participating in the efforts made by the disaster management team. Care would be taken to ensure that no doctor is asked to work for more than twelve hours at a stretch since that would be creating health hazards for the medical professionals(Tiwari, 2016). Property: Having firmed up the action plan for handling with the people and their medical needs the next important job is to ensure that loss to the properties of the people and the nation is minimized. The very old and rare manuscripts of the yesteryears which are available at Varanasi will have to be shifted to some safe place like a tall buildings upper floors so that the rain water is not able to damage these historical relics. There is the very old and respectable Banaras Hindu University (BHU) which is a seat of learning and the properties of BHU will need to be protected from damage. With the flooding of the town of Varanasi it is expected that the power supply will be disrupted very badly and hence alternate sources of power from generators will have to be arranged for ensuring that the BHU is not all that badly affected(Economictimes, 2016). Hence, every action for disinfecting water bodies and other sources of water for consumption by the people mainly by the children are made fully infection and disease free so that the people do not suffer as the flood water recede. Having first and foremost treated the water supply the next step is to ensure that all roads which have been damaged by the floods are repaired immediately. Unless this is done life will not come back to normal and the life of people will be severely restricted by the damaged roads. Trade and industry also will not pick up momentum since the movement of goods will be slow and generally costly(Rediff, 2016). Recommendation for Future Response Plan: The plan for future will have to include certain salient features. First, the state should take the initiative for constructing concrete buildings, at least three stories high, for running their schools and colleges. It may be recalled that these school buildings which are usually three storied structures of concrete are best suited to provide shelters to people whose homes have been inundated by flood waters. Second, the administration will have to have more number of doctors available in the state run hospitals and health centres. This will have to be done by ensuring that no post of any medical personnel goes unmanned even for a day. While the number of doctors may be limited but the number of nursing and medical staff also is great help during such crisis situations(Firstpost, 2016). Third and perhaps the most important aspect of future disaster management at Varanasi would be to ensure that the two rivulets, Varun and Assi, are brought back to their previous condition so that the drainage of water through them during such flood situations is improved. Scandian Myth The Scandinavian myth of creation begins by presenting Odin as the All-Father, a god that is older and mightier than all other beings. Being the ruler of all living things, Odin was responsible for the creation of the skies in the heavens and the ground on the earth. Soon after his formation the planet, the deity composed the first man, breathing life into his body and providing generously a soul to the frame. Even with such apparent power and control over the world, Odin the All-Father, was not the first creature. Before Odin there was only a great emptiness called Ginnungagap and was the only thing that existed. Niflheim, an area filled with mist and ice, was fashioned in the abyss along with Muspellsheim, a section in the south of intense heat and fire. Yggdrasil, the world-tree, and her nemesis, Nidhogg, an evil serpent, were spawned to occupy the space as well. The two points of cold and hot, Niflheim and Muspellsheim, collided into each other, melting the ice with a strong fire. From the interaction, Ymir was formed, the frost-giant who adopted the shape of humans. Giants were produce from his perspiration, causing a massive cow to be grown to feed them. The cow began to lick the ice, resulting in the appearance of hair, a head, and then a full body named Buri. From Buri three gods, Odin, Vili, Ve, were born, producing a new race that killed Ymir. The offspring of Ymir, the giants, drowned in immense sea of his blood. His body made land and his skull into the heavens by three gods. Dwarfs were molded from the maggots that consumed Ymir`s body, while the first man was created from an ash tree and a woman from a vine. In Greece, the origins of creation were not drastically different, referring to the story of King Lycaon of Arcadia. Lycaon was a conventional ruler and man of the age, having no regard for other mortals, beasts, or even gods. Zeus, the god above all others, masquerading carefully in a human form, visited the castle of the great king only to find him and his nobles in celebration. As a practice of the day, the god sat down at the table and ordered a hot meal, expecting a hospitable welcome as a visitor. Having seen through Zeus's ruse, Lycaon replaced him intended dinner with that of human limbs, an effort to murder the god. Zeus rose from the table, scorned and furious, removing all who were present at the banquet with his mighty wrath except for one, Lycaon, a man that was transformed into a wolf. In an attempt to eradicate the mortals, Zeus commanded a flood to be spread upon the earth once he reverted to his original form at Mount Olympus. The creator of humans, a titan Prometheus, forewarned Deucalion, his mortal son, of the destructive plans, allowing him to gather his wife Pyrrha and rations before the danger. Deucaltion and Pyrrha, two individuals that were in Zeus's favor, survived by resting on a chest for nine days and nights, remaining after all mortals had be destroyed. Both looked to the goddess of the titans, Themis, for council, praying for advice of the situation. The goddess instructed for Deucalion to throw stones over his shoulder, resulting in the creation of men, and directed Pyrrha to perform the same, generating women upon the earth from stone. Case Study on the Murder of Bridgett Frisbie Bridgett Frisbie was 17 years old and  in her junior year at Raines High School in Katy, Texas, when she was lured into a wooded area in northwest Harris County and murdered by a close friend and schoolmate. According to authorities, near midnight on April 3, 2011, Bridgett Frisbie snuck out of her house to meet up with friends and was walking down the street when she was spotted by Alan Perez and Alex Olivieri who were out looking for her in Olivieris Chevrolet Suburban. The two men had preplanned to rough her (Frisbie) up that night and had prepared accordingly. Both the men were armed with pistols and Perez was dressed in all black and had a black face mask. When the men spotted Frisbie, Perez hid in the back seat of the car under a pile of blankets, as per their plan. A Threat to His Future Frisbie and Olivieri were good friends, so she had no reason not to accept a ride from him that night. Prosecutors believe that she did not realize the degree of anger Olivieri felt towards her because of a previous incident she had witnessed and was talking about with friends at school. Some weeks before, as a favor to Frisbie, Olivieri allegedly did a drive-by shooting at her ex-boyfriend’s house with his Yugo semiautomatic rifle. According to Perez, Olivieri told him that Frisbie was driving while he sprayed her ex-boyfriends home with bullets. He said Olivieri was worried that, if he was arrested for the shooting, it would hurt his future plans of having a career in the Army. The Murder With Frisbie in the Suburban and Perez hiding undetected in the back seat, Olivieri drove to a wooded area under the false pretense of needing to get something he had buried. Carrying a shovel, he and Frisbie walked into the woods. Perez followed the two from a distance and watched as Olivieri placed his hand on Frisbies back, then he pulled out his gun and  shot her in the back of the neck, killing her instantly. At around 3 a.m. Perez and Olivieri drove to downtown Houston to pick up Frisbies boyfriend, Zacharia Richards, from the Greyhound bus station. According to Perez, meeting Richards in Houston was going to part of the pairs alibi if questioned. On April 3, 2011, the body of Bridgette Frisbee was discovered in the wooded area by a group of children who were out riding dirt bikes. A search of the area turned up one 9 mm shell casing in the vicinity of Frisbies body. When the news of the murder was released, Olivieri text-messaged Perez and pretended to be informing him that their friend had been found dead. Confession for Immunity A few days after the discovery of Frisbies body, Perez, through an attorney, contacted police in regards to information that he had about the murder. Once he was  granted immunity  from prosecution, Perez confessed to what he knew about the murder, including fingering Olivieri as the triggerman. Perez later testified in court that the plan was to rough up Frisbie, but that he did not know of Olivieris plan to murder her and, after the shooting, the two exchanged heated words in the woods. Perez told the court, He came running at me, and I was in shock because he shot her. He described Olivieris attitude after murdering his long-time friend as unrepentant and that he showed no signs of remorse. Perez also admitted to following Olivieris instructions that night, to dress in dark clothing and a full face mask, to bring a firearm, and to hide under a stack of blankets in the back of the Chevrolet Suburban. Alexander Olivieri was found guilty of first-degree murder and was sentenced to 60 years in prison. It took the jury just under four hours to decide on Olivieris sentence. Bridgette Frisbie Bridgetts father Bob Frisbie, who adopted her when she was a toddler, described his daughter as being sometimes rebellious, but that she had  been through a lot in her short life, including the loss of her adoptive mother due to illness. He said that what he saw when he looked at his daughter was a fun-spirited 17-year-old who loved poetry and drawing and was a loving daughter. Olivieris Appeal Olivieris sentence was appealed due to three issues, outlined below from court papers filed by his defense attorneys: Issue One:  The trial court committed reversible error in denying defense counsels request to instruct the jury that Alan Perez was an accomplice witness as a matter of law. According to his attorney, by Perezs own testimony, he had entered into a conspiracy to commit a felony, which resulted in the complainants death. If Perezs testimony is taken as true, then there is no question he engaged in criminal conduct for which he could have been charged had he not been granted immunity. Perez was, therefore, an accomplice as a matter of law. Issue Two:  Insufficient evidence was presented to corroborate the testimony of Alan Perez, an accomplice witness. Olivieris attorney argued that corroboration of an accomplice witnesss testimony requires evidence that tends to link the accused with the crime committed. None of the evidence presented at trial tends to link Olivieri to the murder of the complainant for purposes of corroborating Perezs testimony. Issue Three:  The consent to search provided to law enforcement by Samuel Olivieri was not given voluntarily and was therefore invalid. According to the appeal,  police did not have a warrant  to search the Suburban driven by Olivieri, despite prior knowledge gleaned from Perez that it may contain evidence. As a way around the warrant requirement, police sought and received the consent of Olivieri s father to search the vehicle. The consent by Olivieris father was involuntary, as he was not aware that he had a right to refuse to give consent, had been subjected to a coercive show of authority by law enforcement, and was operating with less than full mental faculties after being awoken at 2 a.m. by police. The Court of Appeals for the First District of Texas overruled the three arguments and voted to uphold the trial court’s judgment. Alex Olivieri is currently housed at the Connally (CY) Correctional Institution in  Kenedy, Texas. His projected release date is November 2071. He will be 79 years old.
